Page 1 of 1 216B.180 Certificate of need not required for respite-service beds in intermediate care facility for the mentally retarded. Notwithstanding any other provisions contained in this chapter, a certificate of need shall
not be required for an existing intermediate care facility for the mentally retarded
(ICF/MR) to add beds which shall be dedicated to providing respite services to
individuals with an ICF/MR level of care for no more than thirty (30) days. The
establishment of ICF/MR respite beds shall be limited to three (3) beds per fifty (50)
ICF/MR beds in a facility and shall not be eligible for Medicaid certification. Beds
designated for respite services under this section shall comply with all applicable federal
and state licensure requirements for intermediate care facilities for the mentally retarded. Effective: July 15, 2002
