Article 2: SUSPENSION WITHOUT CONVICTION
In order to suspend a license or certificate for refusal to allow a shellfish inspection or for violation of shellfish sanitation regulations, the commissioner shall follow the procedures for license suspension or revocation in the District Court, as provided under Title 4, chapter 5. The suspension for these reasons must be a summary action necessary to prevent an immediate threat to the public health, safety and welfare and must be an emergency proceeding under Title 4, section 184, subsection 6. Nothing in this section shall limit the commissioner's powers to embargo or condemn under section 6856. [1977, c. 661, §5 (NEW).]
