Chapter 801-A: FOREST CERTIFICATION INCENTIVE COST-SHARE FUND HEADING: PL 2001, C. 439, PT. KKKK, §1 (NEW); 2005, C. 513, §1 (RPR)
As used in this chapter, unless the context otherwise indicates, the following terms have the following meanings. [2001, c. 439, Pt. KKKK, §1 (NEW).]
1. Bureau. "Bureau" means the Bureau of Forestry within the Department of Conservation.

2. Forest land. "Forest land" means land used primarily to grow trees to be harvested for commercial use but where management objectives may include other values.

3. Independent 3rd-party certification. "Independent 3rd-party certification" means a system that verifies that forest management is consistent with a certification program's standards through an independent 3rd-party audit of the management of forest lands. To be considered an "independent 3rd-party certification" system:
A. The certification program, including, but not limited to, the standards for awarding certification and the protocols for ascertaining compliance, must be developed and administered by an entity with no financial interest in the entity seeking certification except by reason of the contract for certification services; and [2005, c. 513, §3 (NEW).]
B. The organization retained to perform the certification audit may not receive any financial benefit from timber harvesting on the land or from the entity being audited, except for the contractual relationship for the audit service. [2005, c. 513, §3 (NEW).]

4. Licensed forester. "Licensed forester" means a person licensed pursuant to Title 32, chapter 76.
