§ 5-202. Approval of financial assistance from Fund.
 

(a)  In general.- Financial assistance from the Fund may be approved by the Secretary or the Secretary's designee. 

(b)  Essential governmental function.- The exercise by the Department of the powers granted under this subtitle is the performance of an essential governmental function.
