Section 5-201 - Role of Department in general; transfer of jurisdiction from Department of Forests and Parks.

§ 5-201. Role of Department in general; transfer of jurisdiction from Department of Forests and Parks.
 

(a)  Role of Department.- The Department shall promote, administer, and manage every State-owned or leased forest, park, scenic preserve, natural area, parkway, historic monument, and recreation area, administer every law and rule or regulation relating to forests, parks, scenic preserves, natural areas, parkways, historic monuments, recreation areas, fire control, roadside trees, the restoration of deforested or denuded areas, and the operation of the State forest nursery. 

(b)  Transfer of jurisdiction.- Every right, power, duty, obligation, and function conferred upon or exercised by the Department of Forests and Parks is transferred to and exercised by the Department. Every reference to the Department of Forests and Parks which appears in the Code, other laws of the State, or in any ordinance, resolution, rule, regulation, legal action, directive, or document, means the Department.
