Third state building trust fund establishment and maintenance.

8.275. 1. The "Third State Building Trust Fund" is herebyestablished in the state treasury. The fund shall consist of allmoneys transferred to it from the third state building fund asprovided in this section.

2. On the day in each fiscal year prior to the date uponwhich any appropriation from the third state building fund forsuch year would otherwise lapse, the commissioner ofadministration shall transfer from the third state building fundto the third state building trust fund an amount equal to theaggregate of all such balances. The commissioner shall maintainsuch accounts as may be necessary to preserve all balances sotransferred for the benefit of those agencies or entities towhich the appropriations were originally made, and nothing hereinshall be construed so as to permit any amount so transferred tobe appropriated to or otherwise spent for the benefit of anyagency or entity other than that to which the appropriation wasoriginally made. Unexpended balances in the third state buildingtrust fund at the end of any fiscal year shall not be transferredto the general revenue fund or any other fund, the provisions ofsection 33.080, RSMo, to the contrary notwithstanding.

3. Amounts appropriated from the third state building trustfund shall not be considered in determining allocations ofappropriations required to be made from the third state buildingfund for any fiscal year.

4. Any interest or other earnings earned with respect toamounts transferred to the third state building trust fund shallbe credited as earned to the third state building fund.
