Who shall enforce.

8.630. The responsibility for enforcement of sections 8.610to 8.650 shall be as follows:

(1) Where state school funds are utilized, the statedepartment of elementary and secondary education; or

(2) Where state funds are utilized, the division, agency orinstrumentality of the state having jurisdictional control ofthe design function of the work; or

(3) Where funds of counties, municipalities or otherpolitical subdivisions are utilized, the governing bodiesthereof.
