36.360. Layoffs.

Layoffs.

36.360. In accordance with the regulations, an appointing authoritymay lay off an employee in a position subject to this chapter whenever theappointing authority deems it necessary by reason of shortage of work orfunds, or the abolition of a position or other material change in duties ororganization. No regular employee shall be laid off while a person isemployed on a provisional or temporary basis in the same class in thatdivision. The seniority and ability of employees to do the remaining workshall be considered, in such manner as the regulations shall provide, amongthe factors in determining the order of layoffs. The appointing authorityshall give written notice to the director of every proposed layoff areasonable time before the effective date thereof, and the director shalltake such action relating thereto as the director considers necessary tosecure compliance with the regulations. The name of every regular employeeso laid off shall be placed on the appropriate reinstatement register.
