Convening special courts-martial, persons authorized.

40.085. In the state military forces any person authorizedto convene a general court-martial, the commanding officer of agarrison, fort, post, camp, station, air base, auxiliary airbase, or other place where troops are on duty, or of a brigade,regiment, wing, group, separate battalion, separate squadron, orother detached command, may convene special courts-martial. Whenany such officer is an accuser, the court shall be convened bysuperior competent authority and may, in any case, be convened bysuch authority when deemed advisable by him.
