Advising or soliciting--desertion--mutiny--misbehavior before ahostile force--sedition--offense performed, punishment--notperformed, punishment.

40.260. 1. Any person subject to sections 40.005 to 40.490who solicits or advises another or others to desert in violationof section 40.273 or mutiny in violation of section 40.307 shall,if the offense solicited or advised is attempted or committed, bepunished with the punishment provided for the commission of theoffense, but, if the offense solicited or advised is notcommitted or attempted, the person shall be punished as acourt-martial may direct.

2. Any person subject to sections 40.005 to 40.490 whosolicits or advises another or others to commit an act ofmisbehavior before a hostile force in violation of section 40.325or sedition in violation of section 40.307 shall, if the offensesolicited or advised is committed, be punished with thepunishment provided for the commission of the offense, but, ifthe offense solicited or advised is not committed, the personshall be punished as a court-martial may direct.
