Attempts to compel officer to surrender to enemy or to strikecolors without proper authority--court-martial.

40.328. Any person subject to sections 40.005 to 40.490 whocompels or attempts to compel a commander of any place, vessel,aircraft, or other military property, or of any body of membersof this state's or any other state's military forces to give itup to an enemy or to abandon it, or who strikes the colors orflag to an enemy without proper authority, shall be punished as acourt-martial may direct.
