Property, not military--willfully, recklessly wastes or spoils--court-martial.

40.370. Any person subject to sections 40.005 to 40.490 who,while in a duty status, willfully or recklessly wastes, spoils,or otherwise willfully and wrongfully destroys or damages anyproperty other than military property of the United States or ofthis state shall be punished as a court-martial may direct.
