Larceny or wrongful appropriation of property--court-martial.

40.405. 1. Any person subject to sections 40.005 to 40.490who wrongfully takes, obtains, or withholds, by any means, fromthe possession of the owner or of any other person any money,personal property, or article of value of any kind:

(1) With intent permanently to deprive or defraud anotherperson of the use and benefit of property or to appropriate it tohis own use or the use of any person other than the owner, stealsthat property and is guilty of larceny; or

(2) With intent temporarily to deprive or defraud anotherperson of the use and benefit of property or to appropriate it tohis own use or the use of any person other than the owner, isguilty of wrongful appropriation.

2. Any person found guilty of larceny or wrongfulappropriation shall be punished as a court-martial may direct.
