Process or mandates, authority to issue.

40.450. 1. Military courts may issue any process or mandatenecessary to carry into effect their powers. Such a court mayissue subpoenas and subpoenas duces tecum and enforce byattachment attendance of witnesses and production of books andrecords, when it is within the state and the witnesses, books andrecords sought are also so located.

2. Process and mandates may be issued by summarycourts-martial, provost courts, or the president or militaryjudge of other military courts and may be directed to and may beexecuted by the marshals of the military court or any peaceofficer and shall be in such form as may be prescribed byregulations issued under sections 40.005 to 40.490.

3. All officers to whom process or mandates may be sodirected shall execute them and make return of their actsthereunder according to the requirements of those documents.
