Civilian officers to execute required duties, failure to perform,penalty.

40.460. The neglect or refusal of any sheriff, policeofficer, jail warden or magistrate to execute any process, or tomake proper return of all fines and penalties collected, or toreceive in custody any prisoner, shall be deemed a class Cmisdemeanor and shall subject the offender to a prosecution bythe proper prosecuting attorney.
