Organized militia not liable for acts done in performance of duty.

41.700. Whenever any portion of the organized militia iscalled into active service to execute the laws, engage indisaster relief, suppress actual or prevent threatenedinsurrection or repel invasion, the commanding officer shall usehis own discretion with respect to the propriety of attacking orfiring upon any mob or unlawful assembly. His honest andreasonable judgment in the exercise of his duty shall be fullprotection, civilly and criminally, for any act or acts donewhile on duty; and no member of the organized militia in theactive service of the state shall be liable civilly or criminallyfor any act or acts done by him in the performance of his duty.
