Toll-free number for information on registered sexual offenders,contents, procedure, publication--rulemaking authority.

43.533. 1. The highway patrol shall, subject to appropriation,operate a toll-free telephone number in order to disseminate registrationinformation provided by individuals who are required to register undersections 589.400 to 589.425, RSMo, and receive information from personsregarding the residency of a registered sexual offender. The informationavailable via the telephone number shall include only information thatoffenders are required to provide under section 589.407, RSMo. When thehighway patrol provides such information regarding a sexual offender, thepatrol personnel shall advise the person making the inquiry that positiveidentification of a person believed to be a sexual offender cannot beestablished unless a fingerprint comparison is made, and that it is illegalto use such information regarding a registered sexual offender tofacilitate the commission of a crime. The toll-free telephone number shallbe published on the highway patrol's sexual offender registry web sitemaintained under section 43.650.

2. The patrol shall promulgate rules to effect the enforcement ofthis section. Any rule or portion of a rule, as that term is defined insection 536.010, RSMo, that is created under the authority delegated inthis section shall become effective only if it complies with and is subjectto all of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date, or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 2006, shall beinvalid and void.
