43.543. Any state agency listed in section 621.045, RSMo, thedivision of professional registration of the department of insurance,financial institutions and professional registration, the department ofsocial services, the supreme court of Missouri, the state courtsadministrator, the department of elementary and secondary education, theMissouri lottery, the Missouri gaming commission, or any state, municipal,or county agency which screens persons seeking employment with suchagencies or issuance or renewal of a license, permit, certificate, orregistration of authority from such agencies; or any state, municipal, orcounty agency or committee, or state school of higher education which isauthorized by state statute or executive order, or local or countyordinance to screen applicants or candidates seeking or considered foremployment, assignment, contracting, or appointment to a position withinstate, municipal, or county government; or the Missouri peace officersstandards and training, POST, commission which screens persons, notemployed by a criminal justice agency, who seek enrollment or access into acertified POST training academy police school, or persons seeking a permitto purchase or possess a firearm for employment as a watchman, securitypersonnel, or private investigator; or law enforcement agencies whichscreen persons seeking issuance or renewal of a license, permit,certificate, or registration to purchase or possess a firearm shall submittwo sets of fingerprints to the Missouri state highway patrol, Missouricriminal records repository, for the purpose of checking the person'scriminal history. The first set of fingerprints shall be used to searchthe Missouri criminal records repository and the second set shall besubmitted to the Federal Bureau of Investigation to be used for searchingthe federal criminal history files if necessary. The fingerprints shall besubmitted on forms and in the manner prescribed by the Missouri statehighway patrol. Fees assessed for the searches shall be paid by theapplicant or in the manner prescribed by the Missouri state highway patrol.Notwithstanding the provisions of section 610.120, RSMo, all recordsrelated to any criminal history information discovered shall be accessibleand available to the state, municipal, or county agency making the recordrequest.
