71.030. Previous to the presentation of the petitionmentioned in section 71.020, the name proposed to be given tosuch city, town or village shall be filed in the office of thesecretary of state, to be there retained for the period of atleast sixty days, and, upon application, the secretary of stateshall, at any time after the filing of such name, grant acertificate, stating that such name has not been given to anyother city, incorporated town or incorporated village ormunicipality of this state, if such be the fact; but if such namehas been adopted by any other city, town or village ormunicipality, the secretary of state shall so notify the party orparties making such application, in which case another name shallbe filed in his office, which name shall likewise remain for theperiod of sixty days, and no petition shall be acted upon by saidcorporate authorities unless accompanied by the certificate ofthe secretary of state, setting forth that such name has not beenadopted elsewhere in this state.
