Accidental disability retirement.

86.073. Upon application of a member of the board of policecommissioners any member who has become totally and permanentlyincapacitated for duty as the natural and proximate result of anaccident occurring while in the actual performance of duty atsome definite time and place through no negligence on his part,shall be retired by the board of trustees provided that themedical board shall certify that such member is mentally orphysically incapacitated for further performance of duty, thatsuch incapacity is likely to be permanent and that such membershould be retired.
