Condemnation of property--assessment by jury.

88.037. All owners of property to be appropriated shall takenotice of the confirmation of the report of the commissioners asto the assessment of benefits, and any owner of property to beappropriated may, within ten days after such confirmation, filewith the clerk his request that the assessment of damages made bythe commissioners be set aside as to his property and that thedamages be assessed by a jury. If such exceptions are filed byseveral property owners, the issues may, by their consent filedin the cause, be tried as one case by the same jury, the verdictto show the amounts allowed to the several defendants separatelyas to each lot, tract or parcel of land; otherwise the issuesshall be tried separately. The judge shall set the time fortrial, allowing a reasonable time for preparation.
