88.107. If a city of this state has caused to be constructedor reconstructed any sewer, boulevard, street, alley, sidewalk orother local improvement, and to pay the cost of the improvementhas levied a special assessment against private property andissued special tax bills pursuant thereto, and the assessment orany part thereof, or the special tax bills, or any thereof areadjudged invalid and unenforceable either in whole or in part bythe final judgment of any appellate court of competentjurisdiction for any reason other than the failure of thecontractor who has done the work to fully comply with hiscontract, the city may, by ordinance, make a new assessment orreassessment upon all land benefited by the improvement, and inso doing may, if necessary, create a new assessment district anddefine its boundaries.
