Highway patrol uniformed members and civilian employees to bemembers of retirement system--credit for military service,when.

104.030. 1. As an incident to his contract of employment orcontinued employment, each employee of the highways andtransportation commission of Missouri, each uniformed member ofthe highway patrol, and each civilian or nonuniformed employee ofthe Missouri state highway patrol shall become a member of thesystem as established in section 104.020 on November 1, 1955, andevery person thereafter becoming an employee in either of thethree classifications shall become a member at the time ofemployment. Each employee's membership shall continue as long ashe shall continue to be an employee; be on leave for militaryservice or training as hereinafter provided; or receive or beeligible to receive an annuity or benefit hereunder.

2. The military service or training must be that to which heshall have become obligated, either irrespective of his consentunder the mandatory provisions of law or as a volunteer while theUnited States is engaged in actual active armed warfare, ifwithin ninety days after becoming eligible for release from saidservice obligation he shall have reentered the employment of thetransportation department or the state highway patrol. Nopayment of contributions shall be required of suchmember upon his return from military service, but he shall begiven credit for the actual time of military service rendered atthe salary received at the time of entry into military service.
