Second conviction or subsequent time for use of drugs to bedismissed--requirements for rehiring.

105.1108. Any public employee who is convicted, pleadsguilty, or pleads nolo contendere for a second or subsequenttime, under the laws of this state, the United States, or anyother state, of any criminal offense involving the use of acontrolled substance, marijuana or other dangerous drug, as suchsubstances are defined in chapter 195, RSMo, shall be dismissedfrom his public employment and shall be ineligible for otherpublic employment for a period of two years from the most recentdate of conviction. Subsequent employment with a public employerafter the two-year period shall be conditioned upon the showingof evidence of completion of a state certified drug abusetreatment and education program.
