Penalty on delinquents.

105.120. Every such officer who shall fail to pay the amountfound due from him on such settlement, and who shall be returnedby the collector to the county commission as a delinquent, sothat the collector shall be credited in his account with theamount of delinquency, shall forfeit five percent per month uponthe amount due from the time it ought to have been paid untilcollected, which may be recovered by suit upon his official bondor otherwise according to law.
