Employees detailed to this state--qualifications waived--supervisionby agreement--death or disability of.

105.640. 1. When any unit of government of this state actsas a receiving agency, employees of the sending agency who areassigned under authority of sections 105.600 to 105.650 may beconsidered to be on detail to the receiving agency.

2. Appointments of persons so assigned may be made withoutregard to the laws or regulations governing the selection ofemployees of the receiving agency. The person shall be in theunclassified service of the state.

3. Employees who are detailed to the receiving agency shallnot by virtue of the detail be considered to be employeesthereof, except as provided in subsection 4 of this section, norshall they be paid a salary or wage by the receiving agencyduring the period of their detail. The supervision of the dutiesof employees during the period of detail may be governed byagreement between the sending agency and the receiving agency.

4. Any employee of a sending agency assigned in this statewho suffers disability or death as a result of personal injuryarising out of and in the course of the assignment, or sustainedin the performance of duties in connection therewith, shall betreated for the purpose of receiving agency's employeecompensation program, as an employee, as defined in the act, whohas sustained the injury in the performance of the duty, butshall not receive benefits under that act for any period forwhich he elects to receive similar benefits as an employee underthe sending agency's employee compensation program.
