109.221. 1. The state shall establish and administer a "StateHistorical Records Advisory Board". The state historical records advisoryboard shall consist of twelve members appointed by the governor, with theadvice and consent of the senate. Each member shall serve for a term ofthree years, except for the first members appointed, which shall have fourmembers that serve one year, four members that serve two years and fourmembers that serve three years. Thereafter, each member shall serve threeyears. The secretary of state shall serve as chairman of the board and asthe state historical records coordinator and his vote shall break any tievote of the board. The executive director of the state historical societyof Missouri shall serve as an ex officio member of the board. The boardshall meet when called by the chairman, but shall meet at least annually.The board shall adopt written procedures to govern its activities. Theboard shall report annually to the general assembly on its activities.

2. The state historical records advisory board is assigned to theoffice of the secretary of state. Members of the board shall receive nocompensation for their service, but shall be reimbursed for their actualand necessary expenses incurred in the performance of their duties.

3. The board shall be the central advisory body for historicalrecords planning and for projects relating to historic records developedand carried out within the state of Missouri. The board may perform dutiessuch as sponsoring and publishing surveys of the conditions and needs ofhistorical records in the state; soliciting or developing proposals forprojects to be carried out in the state with the National HistoricalPublications and Records Commission, hereafter called "commission",financing; reviewing records proposals by institutions in the state andmaking recommendations from these to the commission; developing, revising,and submitting to the commission state priorities for historical recordsprojects following guidelines developed by the commission; and reviewing,through reports and otherwise, the operation and progress of recordsprojects in the state.

4. The board may seek funds available through the National HistoricalPublications and Records Commission for the subvention of all or part ofthe costs of printing and manufacturing volumes that have been formallyendorsed by the commission.

5. The board may seek funds from the National Historical Publicationsand Records Commission for sponsoring and publishing surveys of theconditions and needs of historical records in the state; for soliciting ordeveloping proposals for projects to be carried out in the state forpreservation of historical records and publications; for reviewing recordsproposals by institutions in the state and making recommendations fromthese to the commission; and for developing, revising, and submitting tothe commission state priorities for historical records projects followingguidelines developed by the commission. The board may further carry outthose necessary duties to fulfill its purpose of helping in the collectionand preservation of Missouri's historical records and such other duties asmay be prescribed by law.

6. The secretary of state, as state historical records coordinator,may fund and administer, with the advice of the state historical recordsadvisory board, grant requests for preservation of local records. Incarrying out this subsection the secretary of state shall have the power topromulgate necessary rules and regulations. No rule or portion of a rulepromulgated under the authority of this section shall become effectiveunless it has been promulgated pursuant to the provisions of section536.024, RSMo. Funds retained by the recorder of a county or a city notwithin a county and deposited in a recorder's fund for records preservationpurposes pursuant to subsection 1 of section 59.319, RSMo, may be used by arecorder of a county or a city not within a county toward any localmatching funds requirement for funding pursuant to the grant programauthorized by this subsection. A recorder's application for grant fundingpursuant to this subsection shall not be penalized in any way because localfunds collected pursuant to subsection 1 of section 59.319, RSMo, are to beused to fund any local matching funds requirement.
