Disposition of nonrecord material, director to retain certain copies,when.

109.265. The state records commission may determine that certainmaterial under the permanent control of the director of records managementand archives service is nonrecord material pursuant to section 109.260, andupon such determination may direct the sale or transfer of such material bythe director upon such terms as deemed appropriate by the commission. Thedirector shall retain a representative copy of any material subject to saleor transfer if no other copies of the material are within the permanentcontrol of the director. All proceeds of such sale or transfer shall bedeposited in the state document preservation fund established pursuant tosection 109.005.
