Rules and policies, department has affirmative duty to seek commenton--review of existing rules and policies, procedure.

161.209. The department of elementary and secondary education has anaffirmative duty to seek comment on its rules, regulations, and policiesafter their final approval or implementation. The department shallundertake such review on existing rules, regulations, and policies on an adhoc, periodic basis with a priority given to such rules, regulations, andpolicies that could successfully be revised without affecting studentachievement to accommodate periods when there is no increase in theappropriation for basic state aid funding pursuant to section 163.031,RSMo, from one fiscal year to the next or when withholdings of appropriatedfunds result in a situation equivalent to no increase in suchappropriation.
