167.346. 1. The state board of education shall develop a list ofrecommended reading assessments for kindergarten through grade three pupilsby July 1, 2000. Such assessments shall have a demonstrated effectivenessbased on research. The list shall incorporate a variety of methods and mayalso include reading improvement programs. The list shall serve as aguideline for districts choosing reading improvement assessment andinstructional methods pursuant to the grant program established in section167.343. Districts are not required to use a reading assessment from thelist developed pursuant to this section. The department shall review theresults of the grants and determine which reading instruction programs havebeen particularly effective and use this information to update its initiallist.
2. The state board of education shall develop guidelines to applyreading assessment results to instructional programs and the training ofteachers and administrators in assisting pupils identified as reading belowgrade level.
3. The department of elementary and secondary education shall adoptrules to implement the provisions of sections 167.340 to 167.346.
4. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thissection shall become effective only if it complies with and is subject toall of the provisions of chapter 536, RSMo, and, if applicable, section536.028, RSMo. This section and chapter 536, RSMo, are nonseverable and ifany of the powers vested with the general assembly pursuant to chapter 536,RSMo, to review, to delay the effective date or to disapprove and annul arule are subsequently held unconstitutional, then the grant of rulemakingauthority and any rule proposed or adopted after August 28, 1999, shall beinvalid and void.
