171.141. 1. As used in this section, a school fraternity orsorority is any organization composed wholly or in part of publicschool pupils, which seeks to perpetuate itself by taking inadditional members from the pupils enrolled in public highschools, junior high schools or elementary schools on the basisof the decision of its membership rather than upon the freechoice of any pupil in the school who is qualified by the rulesof the board to fill the aims of the organization.

2. The school board of any school district, by rule, mayprohibit membership of pupils in school fraternities orsororities composed of pupils in any high school, junior highschool or elementary school in the district, when it deems thatmembership in the fraternities or sororities detrimentallyaffects the conduct and discipline of the schools in thedistrict. Any rule adopted under this subsection shall prescribethe aim of school organizations which may be formed and thequalifications of pupils eligible for membership therein. Theboard may adopt other rules that are necessary to carry out thepurposes of this section.

3. Upon the adoption of the rule authorized by subsection 2,the school board may suspend, discipline and expel from theschools under its control, any pupil who remains a member of, whojoins or promises to join, or who becomes pledged to become amember, or who solicits any other person to join, promise to joinor be pledged or to become a member of a school fraternity orsorority. Upon direction of the board, by rule or otherwise, thesuperintendent of schools may suspend and discipline any personwho violates the rule authorized by subsection 2 until the timethat the matter is considered by the board.
