191.725. Beginning January 1, 1992, every licensed physician whoprovides obstetrical or gynecological care to a pregnant woman shall counselall patients as to the perinatal effects of smoking cigarettes, the use ofalcohol and the use of any controlled substance as defined in section 195.017,RSMo, schedule I, II, or III for nonmedical purposes. Such physicians shallfurther have all patients sign a written statement, the form of which will beprepared by the director of the department of health and senior services,certifying that such counseling has been received. All such executedstatements shall be maintained as part of that patient's medical file. Thedirector of the department of health and senior services, in cooperation withthe department of mental health, division of alcohol and drug abuse, shallfurther provide educational materials and guidance to such physicians for thepurpose of assuring accurate and appropriate patient education.
