191.850. Definitions.

Definitions.

191.850. As used in sections 191.850 to 191.863, the following termsmean:

(1) "Accessibility", compliance with nationally acceptedaccessibility and usability standards, such as those established in Section255 of the Telecommunications Act of 1996 and Section 508 of the WorkforceInvestment Act of 1998;

(2) "Assistive technology device", any item, piece of equipment, orproduct system, whether acquired commercially off the shelf, modified, orcustomized, that is used to increase, maintain or improve functionalcapabilities of individuals with disabilities;

(3) "Assistive technology service", any service that directly assistsan individual with a disability in the selection, acquisition or use of anassistive technology device. Such term includes:

(a) The evaluation of the needs of an individual with a disability,including a functional evaluation of the individual in the individual'scustomary environment;

(b) Purchasing, leasing or otherwise providing for the acquisition ofassistive technology devices by individuals with disabilities;

(c) Selecting, designing, fitting, customizing, adapting, applying,maintaining, repairing or replacing assistive technology devices;

(d) Coordinating and using other therapies, interventions or serviceswith assistive technology devices, such as those associated with existingeducation and rehabilitation plans and programs;

(e) Training or technical assistance for an individual withdisabilities, or, where appropriate, the family of an individual withdisabilities; and

(f) Training or technical assistance for professionals, includingindividuals providing education and rehabilitation services, employers, orother individuals who provide services to, who employ, or who are otherwisesubstantially involved in the major life functions of individuals withdisabilities;

(4) "Individual with disabilities", any individual who is consideredto have a disability or handicap for the purposes of any federal orMissouri law;

(5) "Information technology", any electronic information equipment orinterconnected system that is used in the acquisition, storage,manipulation, management, movement, control, display, switching,interchange, transmission, or reception of data or information, includingaudio, graphic and text;

(6) "State department or agency", each department, office, board,bureau, commission, or other unit of the executive, legislative or judicialbranch of state government, including public four-year and two-yearcolleges and universities;

(7) "Undue burden", significant difficulty or expense, including, butnot limited to, difficulty or expense associated with technicalfeasibility.
