192.762. 1. The department of health and senior services shallpromulgate rules providing for general or specific licenses or registration,or exemption from licensing or registration, for radioactive materials andother sources of ionizing radiation used to perform mammography, pursuant tothe provisions of section 192.006 and chapter 536, RSMo. The rules shallprovide for amendment, suspension or revocation of licenses. In connectionwith those rules, the department of health and senior services may promulgaterules to establish requirements for record keeping, permissible levels ofexposure, notification and reports of accidents, protective measures,technical qualifications of personnel, handling, transportation,interpretation, storage, waste disposal, posting and labeling of hazardoussources and areas, surveys and monitoring. The department shall promulgaterules and regulations specifying a patient notification/recall system whendeficiencies are found in mammography. These rules and regulations shall befairly consistent with recall criteria of national accrediting programs whereavailable.
2. The rules promulgated pursuant to sections 192.760 to 192.766 shallnot limit the intentional exposure of patients to radiation for the purpose oflawful therapy or research, as authorized by law.
3. The department of health and senior services shall promulgate rulesspecifying the minimum training and performance standards for an individualusing a radiation machine for mammography as set forth in section 192.766.
4. In promulgating rules pursuant to sections 192.760 to 192.766, thedepartment shall avoid requiring dual licensing, insofar as practical. Rulespromulgated by the department may provide for recognition of other state orfederal licenses as the department considers desirable, subject toregistration requirements prescribed by the department.
