193.105. 1. When a certificate of birth of a person bornin this state has not been filed within the time period providedin section 193.085, a certificate of birth may be filed inaccordance with regulations of the department and registeredsubject to such evidentiary requirements as the department shallby regulation prescribe to substantiate the alleged facts ofbirth.
2. Certificates of birth registered one year or more afterthe date of birth shall be made on forms prescribed andfurnished by the state registrar, marked "Delayed", and shallshow on their face the date of the delayed registration.
3. A summary statement of the evidence submitted in supportof the delayed registration shall be endorsed on thecertificate.
4. When an applicant does not submit the minimumdocumentation required in the regulations for delayedregistration or when the state registrar has reasonable cause toquestion the validity or adequacy of the applicant's swornstatement or the documentary evidence, and if the deficienciesare not corrected, the state registrar shall not register thedelayed certificate of birth and shall advise the applicant ofthe reasons for this action, and shall further advise theapplicant of his or her right of appeal to a court of competentjurisdiction.
