Disposition of cremated remains--if no directions are given,procedure, notice.

194.350. A licensed funeral establishment which cremates, orcontracts for the cremation of, a dead human body, whether thecremation occurs before or after August 28, 1989, may dispose ofthe cremated remains by:

(1) Delivering the remains to or as directed by anotherlicensed funeral establishment which contracted for thecremation;

(2) Delivering the remains to or as directed by the personwho contracted for the cremation; or

(3) If not delivered pursuant to subdivision (1) or (2) ofthis section, by scattering or interring the unclaimed crematedremains in a scatter garden or pond, columbarium or other placeformally dedicated for the burial of dead human bodies, provided,at least ninety days prior to such scattering or interment thefuneral establishment shall send a written notice by certifiedmail, return receipt requested, to the licensed funeralestablishment or person who contracted for the cremation statingthat the remains will be scattered or interred under thissubdivision unless the notified establishment or person, or otherperson authorized by the notified establishment or person, claimsand removes the remains prior to the end of such ninety-dayperiod, and provided further, if such mailed notice cannot bedelivered, at least thirty days prior to such scattering orinterment the funeral establishment shall publish a notice oncein a newspaper in general circulation in the county in which thefuneral establishment is located stating that the remains will bescattered or interred under this subdivision unless the licensedfuneral establishment or person who contracted for the cremation,or other person authorized by the contracting establishment orperson, claims and removes the remains prior to the end of suchthirty-day period.
