Unlawful endangerment of property, penalty.

195.219. 1. A person commits the crime of unlawful endangerment ofproperty if, while engaged in or as a part of the enterprise for theproduction of a controlled substance, he protects or attempts to protectthe production of the controlled substance by creating, setting up,building, erecting or using any device or weapon which causes or isintended to cause damage to the property of, or injury to, another person.

2. Unlawful endangerment of property is a class C felony, unlessthere is physical injury to a person whereby the offense is a class Bfelony, or there is serious physical injury to a person whereby the offenseis a class A felony.
