Inapplicability of sections to dementia care units in certaincounties (including Jackson County) and to certain not-for-profitcorporations.

197.314. 1. The provisions of sections 197.300 to 197.366 shall notapply to any sixty-bed stand-alone facility designed and operated exclusivelyfor the care of residents with Alzheimer's disease or dementia and located ina tax increment financing district established prior to 1990 within any countyof the first classification with a charter form of government containing acity with a population of over three hundred fifty thousand and which districtalso has within its boundaries a skilled nursing facility.

2. The provisions of sections 197.300 to 197.366 shall not apply, ashereinafter stated, to a skilled nursing facility that is owned or operated bya not-for-profit corporation which was created by a special act of theMissouri general assembly, is exempt from federal income tax as anorganization described in Section 501(c)(3) of the Internal Revenue Code of1986, is owned by a religious organization and is to be operated as part of acontinuing care retirement community offering independent living, residentialcare and skilled care. This exemption shall authorize no more than twentyadditional skilled nursing beds at each of two facilities which do not haveany skilled nursing beds as of January 1, 1999.
