Licensed bed limitation imposed, when.

197.367. Upon application for renewal by any residential care facilityor assisted living facility which on the effective date of this act** has beenlicensed for more than five years, is licensed for more than fifty beds andfails to maintain for any calendar year its occupancy level above thirtypercent of its then licensed beds, the division of aging shall license onlyfifty beds for such facility.
