Refusal to issue, suspension or revocation of license, grounds--rightto administrative review.

197.440. 1. The department shall refuse to issue or shallsuspend or shall revoke the license of any home health agency forfailure to comply with any provision of sections 197.400 to197.475 or with any rule or standard of the department adoptedunder the provisions of sections 197.400 to 197.475 or forobtaining the license by means of fraud, misrepresentation, orconcealment of material facts.

2. Any home health agency which has been refused a licenseor which has had its license revoked or suspended by thedepartment may seek a review of the department's action by theadministrative hearing commission.
