Offering or making kickbacks, bribes or rebates prohibited, when.

198.148. A health care provider or vendor shall notpurposely offer or make any payment, including withoutlimitation, any kickback, bribe or rebate, directly orindirectly, overtly or covertly, in cash or in kind, to anyperson to induce the person:

(1) To refer an individual to a person for the furnishing orarranging for the furnishing of any item or service for whichpayment may be made in whole or in part under Medicaid; or

(2) To purchase, lease, order or arrange for or recommendpurchasing, leasing or ordering any good, facility, service oritem for which payment may be made in whole or in part underMedicaid.
