Usual trade discounts and employment benefits not kickbacks,bribes or rebates.

198.151. Sections 198.145 and 198.148 do not apply to:

(1) Any usual trade discount which is dependent solely upontime of payment or quantity buying to wholesalers which isobtained by a health care provider regardless of whetherreflected in the cost claimed or charges made by the health careprovider under Medicaid; and

(2) Any amount paid by an employer to an employee, who has abona fide employment relationship with the employer, foremployment in the provision of covered services or items.
