198.401. Nursing facility reimbursement allowance, definitions.
198.401. 1. Each nursing facility, except for state-ownedand -operated facilities, shall, in addition to all other feesand taxes now required or paid, pay a nursing facilityreimbursement allowance for the privilege of engaging in thebusiness of providing nursing facility services, other thanservices in an institution for mental diseases, in this state.
2. For the purpose of this section, the phrase "engaging inthe business of providing nursing facility services, other thanservices in an institution for mental diseases, in this state"means accepting payment for such services.
3. For the purpose of this section, the term "nursingfacility" shall be defined using the definition in section 1396r,Title 42 United States Code, as amended, and as such qualifies asa class of health care providers recognized in federal Public Law102-234 Medicaid Voluntary Contribution and Provider Specific TaxAmendment of 1991.
