Determination of amount due--notification, payments--offset allowed.

198.409. 1. The director of the department of social services shallmake a determination as to the amount of nursing facility reimbursementallowance due from each nursing facility.

2. The director of the department of social services shall notify eachnursing facility of the annual amount of its reimbursement allowance on orbefore the first day of October each year. Such amount may be paid inmonthly* increments over the balance of the reimbursement allowance period.

3. The department of social services may offset the nursing facilityreimbursement allowance owed by the nursing facility against any payment duethat nursing facility only if the nursing facility requests such an offset.The amounts to be offset shall result, so far as practicable, in withholdingfrom the nursing facility an amount substantially equivalent to thereimbursement allowance owed by the nursing facility. The office ofadministration and state treasurer may make any fund transfers necessary toexecute the offset.
