Finality of determination, protest--hearing, reconsideration, appeal.

198.412. 1. Each nursing facility reimbursement allowancedetermination shall be final after receipt of written notice fromthe department of social services, unless the nursing facilityfiles a protest with the director of the department of socialservices setting forth the grounds on which the protest is based,within thirty days from the date of receipt of written noticefrom the department of social services to the nursing facility.

2. If a timely protest is filed, the director of thedepartment of social services shall reconsider the determinationand, if the nursing facility has so requested, the director orthe director's designee shall grant the nursing facility ahearing to be held within forty-five days after the protest isfiled, unless extended by agreement between the nursing facilityand the director. The director shall issue a final decisionwithin forty-five days of the completion of the hearing. Afterreconsideration of the reimbursement allowance determination anda final decision by the director of the department of socialservices, a nursing home's appeal of the director's finaldecision shall be to the administrative hearing commission inaccordance with sections 208.156 and 621.055, RSMo.
