Contingent application of requirements--disbursement of fund, when.

198.431. The requirements of sections 198.401 to 198.433 shall applyonly as long as the revenues generated under section 198.401 are eligible forfederal financial participation as provided in sections 198.401 to 198.433 andpayments are made pursuant to the provisions of section 198.401. For thepurpose of this section, "federal financial participation" is the federalgovernment's share of Missouri's expenditures under the Medicaid program.Notwithstanding anything in this section to the contrary, in the event federalfinancial participation is either denied, discontinued, reduced in excess offive percent per year or no longer available for the revenues generated undersection 198.401, the director of the department of social services shall causedisbursement of all funds held in the nursing facility reimbursement allowancefund to be made to all nursing facilities in accordance with regulationspromulgated by the department of social services, along with a full accountingof such disbursements, within forty-five days of receipt of notice thereof bythe department of social services.
