198.534. Rulemaking authority.
198.534. In consultation with consumers, providers and others, thedivision shall promulgate rules and regulations to implement the provisionsof this section and sections 198.080, 198.086, 198.526, 198.532 and198.533. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in thissection and sections 198.080, 198.086, 198.526, 198.532 and 198.533 shallbecome effective only if it complies with and is subject to all of theprovisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo.This section and chapter 536, RSMo, are nonseverable and if any of thepowers vested with the general assembly pursuant to chapter 536, RSMo, toreview, to delay the effective date or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 1999, shall be invalidand void.
