204.260. 1. The circuit court shall within thirty daysafter receiving the petition appoint three disinterested persons,one of whom shall be a licensed civil engineer or surveyor, ascommon sewer district commissioners to lay out and define theboundaries of the proposed district.

2. The common sewer district commissioners may alter oramend the boundaries of the proposed district as set forth in thepetition so that it embraces all of the area capable of beingefficiently drained by the system of trunk sewers, or so as toexclude from the district any part of the natural drainage areawhich is so situated as not to be benefited by the proposed trunksewers or treatment plants, and for this purpose they shall havepower to have made all surveys and maps necessary to locate anddescribe the boundaries.

3. The common sewer district commissioners shall qualify bytaking an oath to faithfully and impartially perform their dutiesand when so qualified shall give notice by publication at leastfive times, in one or more newspapers having a generalcirculation in the proposed district, of the time and place wherethey will meet to consider and establish the boundaries. Thenotice shall be given at least twenty days prior to the meeting,and the meeting place shall be in the courthouse of the county inwhich the major portion of the proposed district lies.

4. At the meeting the common sewer district commissionerfirst named in the order of appointment shall preside, and allpersons residing or owning real property in the proposeddistrict, or adjacent thereto, shall have the right to be heardas to the location of the boundaries of the proposed district;and the common sewer district commissioners or a majority of themafter the hearing shall fix and determine the boundaries of theproposed district.

5. The common sewer district commissioners may adjourn fromday to day until the hearings are complete, and for theirservices shall receive such compensation as may be determined bythe circuit court which appoints them. They may employ acompetent person as stenographer and clerk, whose compensationshall be as set by the circuit court.
