Health and welfare department authorized--certain countiesexcepted.

205.765. 1. The county commission of any county of thefirst class may by resolution create a department of health andwelfare which department shall be operated in the mannerhereinafter set out.

2. Notwithstanding the provisions of subsection 1, nodepartment of health and welfare shall be created in any countyof the first class not having a charter form of government inwhich a county health center has been established pursuant to theprovisions of sections 205.010 to 205.150, whether or not thehealth center is established prior to the county's attainingfirst class status.
