205.984. 1. There shall be established a board oftrustees of not less than nine members appointed by the countyor participating counties in a service area. The regionaladvisory council, as defined in section 632.040, RSMo, or anyother interested party may nominate individuals for membershipon the board. The governing body of the county or countiesshall appoint the members to such board of trustees within oneyear of January 1, 1991. No more than one-third of the membersshall represent public or private entities involved in theprovision of services as provided by sections 205.975 to205.990. At least one-third of the members shall representconsumers of psychiatric services or the families of suchconsumers. Employees of public or private entities which arerecipients of funds pursuant to sections 205.975 to 205.990 areprohibited from serving on this board of trustees.

2. The composition of the board of trustees shall berepresentative of the residents of the county or participatingcounties within a service area, taking into consideration theiremployment, age, sex, and place of residence and otherdemographic characteristics of the area. At least one membershall be a licensed physician and at least one-half of themembers of such body shall be individuals who are not providersof health care.

3. For multicounty service areas, each participating countyshall have at least one representative on the board of trustees.The remaining members shall be appointed in proportion to thepopulations of the participating counties within the servicearea.

4. The terms of office of the members of the board oftrustees shall be three years except that of the firstappointments, the terms of the members shall be staggered asfollows:

(1) In multicounty service areas, one member from eachcounty shall be appointed to a three-year term. Counties whichhave two or more representatives shall appoint one member to atwo-year term. Counties having more than two representativesshall appoint one-third of its members to one-year terms,one-third to two-year terms, and one-third to three-year terms.

(2) In service areas entirely within a county, one-third ofthe members shall be appointed for one year, one-third for twoyears, and one-third for three years.
